O R D E R
This writ petition has been filed seeking a direction to the 2nd and 3rd respondent herein to cancel the patta 1045 in Kezha ambur granted in favour the 4th respondent herein and restore the original pathway / cart track within the time stipulated by this Court.
2. Heard the learned counsel for the petitioner, the learned Special Government Pleader appearing for the respondents 1 to 3 and the learned counsel for the 4th respondent.
3. The petitioner submitted a representation dated 17.02.2023 to the respondents 2nd and 3rd respondent herein to cancel the patta No. 1045 granted in favour the 4th respondent herein and restore the original pathway / cart. However, no action has been taken on the said representation. Hence, the present writ petition has been filed.
4. Learned Special Government Pleader, appearing for the respondents, submits that the Revenue Divisional Officer has rejected the representation of the petitioner on 23.02.2023. 2/5
5. At this juncture, the learned counsel for the petitioner submits that as against the said order, the petitioner preferred an appeal before the first respondent/District Revenue Officer and the same is pending and a direction may be issued to the District Revenue Officer to dispose the appeal.
6. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the 1st respondent consider the petitioner's appeal, after giving notice to all the parties, and pass appropriate orders on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. Needless to say, if any rival claims, the same shall be subject to the jurisdiction of the civil Court. There shall be no order as to costs.
