PRAYER :- For Bail in Crime No. 985/2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners, who arrayed as accused Nos.1 to 3, were arrested and remanded to Judicial Custody on 08.10.2022 for the offences punishable under sections 5, 20(1), 22(a), 24(1) of Cigarette and other Tobacco Products Act, 2003 and Section 328 IPC, in Crime No.985 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on receiving secret information on 07.10.2022, the respondent police conducted raid and the petitioners herein have found in possession of 137 Kgs of Tobacco products illegally. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution.

CRL OP(MD). No.19054 of 2022 4.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that initially 137 kgs of Kanja recovered from the petitioners and subsequently, they were found in possession of 10 Tonnes of Tobacco products. He would further submit that the investigation of the case is in initial stage and strongly opposed to grant bail to petitioners.

5.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Crl. Side), this Court is not inclined to grant anticipatory bail to the petitioners.
