PRAYER :- For Bail in Crime No.834 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 25.10.2021 for the alleged offence under Sections 457 and 380 IPC in Crime No.834 of 2021, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that when the defacto complainant went to Sivagangai, totally three sovereigns of gold jewels were found stolen from the house of the defacto complainant. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. The petitioner's name was not found in the FIR. The petitioner was arrested in Crime NO.1085 of 2021 and remanded to judicial custody on 06.10.2021 and released only on 28.10.2021. At that time on 25.10.2021 his name was implicated.

4.The learned Additional Public Prosecutor submitted that only formal arrest has been made in this case stating that the petitioner is involved in this offence.

No.20617 of 2021 5.Considering the fact the petitioner is in custody for more than 58 days and investigation is pending, this Court is inclined to grant bail to the petitioner with conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Srirangam and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 22/12/2021 / TRUE COPY / 22/12/2021 Sub-Assistant Registrar (C.S.)
