(Order of the Court was made by R.SUBRAMANIAN, J.) Mr.K.Govindarajan, learned Deputy Solicitor General has obtained instructions on our queries regarding the vacancies in the Debts Recovery Tribunals across Tamil Nadu. It is seen from the instructions issued that Debts Page No.1 of 3
Recovery Tribunals-2 and 3 at Chennai and Debts Recovery Tribunal, Coimbatore, are vacant. Additional charge of the Debts Recovery Tribunals-2 and 3 at Chennai, has been assigned to the Presiding Officer of the Debts Recovery Tribunal-1, Chennai. Additional charge of the Debts Recovery Tribunal at Coimbatore, has been assigned to the Presiding Officer of the Debts Recovery Tribunal, Madurai. Since the Presiding Officer of the Debts Recovery Tribunal, Madurai, is on leave, the additional charge of Madurai and Coimbatore has been assigned to the Debts Recovery Tribunal, Ernakulam. It is stated that filing is accepted at Debts Recovery Tribunal, Madurai, and hearing is done by video conferencing also.

In view of the same, this Writ Petition is dismissed leaving it open to the petitioner to move the Debts Recovery Tribunal concerned. The Bank will defer the sale by a month without further notice. No costs. Consequently, connected miscellaneous petition is closed.
