PRAYER: Transfer Miscellaneous Petition filed under Section 24 of Civil Procedure Code, to withdraw the case in H.M.O.P.No.123 of 2021 on the file of the Subordinate Court, Tiruchendur and transfer the same to Subordinate Court, Paramakudi for disposal. For Petitioner : Mr.Y.Prakash For Respondent : No Appearance

O R D E R

This Civil Revision Petition has been filed to withdraw the H.M.O.P.No.123 of 2021 from the file of the Subordinate Court, Tiruchendur and transfer the same to the file of Subordinate Court, Paramakudi for disposal.

2.The learned counsel for the petitioner submitted that the marriage between the petitioner and the respondent took place at Paramakudi. The respondent/husband filed H.M.O.P.No.123 of 2021 before the Subordinate Court, Tiruchendur. He further submitted that the petitioner is residing at Chennai and her parents are having various health issues, so the petitioner is not in a position to travel to Tiruchendur. So she cannot go to Tiruchendur to conduct the case and the respondent is also working at Paramakudi. Hence, she seeks transfer of case.

3.Considering the facts and circumstances of the case and also considering the submission made the learned counsel for the petitioner, HMOP.No.123 of 2021 is ordered to be withdrawn from the file of Subordinate Court, Tiruchendur and transferred to the file of Subordinate Court, Paramakudi and to dispose of the same as per law as expeditiously as possible.

Tr.C.M.P(MD).No.623 of 2021 4.In the result, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
