ORDER

The learned Counsel for the Petitioner submitted that this Petition had been filed to direct the second Respondent to take action on 1/4

the Petitioner's complaint dated 14.10.2022 under the criminal law in the light of the dictum laid down by the Hon'ble Supreme Court of India in the case of Lalita Kumari vs. Government of Uttar Pradesh and Ors. reported in (2014) 2 SCC 1.

2.When the Writ Petition is taken up for hearing, the learned Additional Public Prosecutor submitted that based on the complaint of the Petitioner, enquiry was conducted by the Respondent Police and the Petitioner himself had not appeared for the enquiry conducted by the Respondent Police. The submission of the learned Additional Public Prosecutor is recorded.

3.In the light of the submission made by the learned Additional Public Prosecutor as well as in the light of the order of the Honourable Division Bench of this Court in CDJ 2018 MHC 5100, in the case of G.Prabakaran vs The Superintendent of Police, Thanjavur District and another, this Writ Petition is dismissed as not maintainable. No costs.
