: Mrs.D.Farjana Ghoushia Special Government Pleader COMMON ORDER These Writ Petitions have been filed for almost an identical relief to take appropriate action against the fourth respondent in the light of Circular vide Letter No.41530/U1/2017 dated 08.11.2017 based on the petitioners' representation dated 17.01.2018.
2. The case of the petitioners is that the fourth respondent has created forged documents and executed sale deeds in his favour and the same have also been registered before the third respondent, Sub Registrar, Pudukkottai. It is therefore submitted that suitable action should be taken by the respondents 1 to 3 against the fourth respondent in terms of Circular No.41530/U1/2017 dated 08.11.2017.
3. The second respondent has filed a counter affidavit wherein it has been stated that the second respondent is ready to conduct enquiry on the basis of the representations of the respective petitioners as per the above said Circular dated 08.11.2017. It is further stated that the respective Page No. 2 of 5
petitioners are claiming to be the owners of the lands purchased by them in the year 1981 and after a lapse of 29 years, another document has been registered before the third respondent as if the fourth respondent is the purchaser of the lands in question.
4. It is further stated that assuming the second respondent has conducted an enquiry under Section 68(2) of the Registration Act, 1908, if any fraud or forgery is noticed, appropriate action will be initiated both against the third respondent and the perpetrator of the crime.
5. In view of the above, as far as cancellation of sale deeds are concerned, it is for the respective petitioners to file a suit to declare the registration of the sale deeds by the fourth respondent as illegal in the manner known to law.
