ORDER : The Court made the following order :- The petitioner/Accused No.3, apprehending arrest at the hands of the respondent police for the offences punishable under sections 392 and 397 of I.P.C., in Crime No.402 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that on 11.01.2022 at about 00.30 hours at the Service Road to New Bridge, Panamangalam, Trichy to Chennai National Highway Road, three persons appeared and assaulted the defacto complainant and took away his Lava Button Phone worth about Rs.1,400/- cash valuing Rs.2,800/- and threatened with dire consequences. Hence, the complaint. 3.The learned counsel for the petitioner submitted that now the petitioner has completed 12th standard from Government Higher Secondary School. He was wrongly implicated on the confession of coaccused. A1 and A2 were already arrested and remanded in the judicial custody. CRL OP(MD). No.20605 of 2021 recovered only from the above said persons.
4.Considering the seriousness of the offences and even though the petitioner is not having no previous case, this Court is not inclined to grant anticipatory bail to the petitioner. The offence of this nature requires custodial interrogation. I find no merits in this case.
