PETITION FOR RELAXATION Under Section 439(1)b of Cr.P.C PRAYER :- To relax the condition imposed on the petitioner by this Court in Crl.O.P.(MD)No.5175 of 2025 dated 09.05.2025. ORDER : The Court Made the following order :- This petition has been filed to relax the condition imposed on the petitioner in Crl.O.P(MD)No.5175 of 2025, dated 09.05.2025.

2. The learned counsel for the petitioner submitted that the petitioner has complied with the conditions (i) and (ii). As far as the condition (iii) is concerned, the petitioner is aggrieved by the restriction prohibiting him from entering Naadimuthu Street, Pattukottai, without obtaining prior permission from the Trial Court. He further submitted that the petitioner is a partner in a horse training school, he is having a property situated in the said street and is also constructing a restaurant therein. Therefore, the petitioner is seeking to relax the said condition. He further submitted that the victim girl is not residing in the said area and she is staying in a hostel.

3. The learned Government Advocate (Crl. Side) submitted that the petitioner has been complying with the condition for nearly 16 weeks.

4. In view of the above, this Court is inclined to relax that portion of the condition (iii) which prohibited the petitioner from entering Naaadimuthu Street, Pudukottai and the same is relaxed. However, the restriction prohibiting the petitioner from entering the defacto complainant's house or workplace, as well as the victim's house or the school where she is studying, shall continue to remain in force. As far as the condition (ii) is concerned, since the petitioner has complied with the same for more than 16 weeks, the said condition is also relaxed. Since the trial has commenced, the petitioner is directed to appear before the Trial Court on hearing dates without fail.
