Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus, directing the respondents to settle the petitioner's retirement benefits including Commutation of Pension and other benefits payable to him as per the settlement dated 13.04.2015 U/S 12(3) of I.D. Act w.e.f 01.09.2013 based on the petitioner's representation dated 28.10.2016 with reasonable rate of interest within the time stipulated by this Hon'ble Court. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.G.M.XAVIER, Advocate for the petitioner and of Mr.D.
SIVARAMAN, Advocate on behalf of the Respondents, the court made the following order:- This petition has been filed by the petitioner praying to reopen the Contempt Petition, which was closed on 30.01.2018 with liberty to the petitioner to revive the same, in case the interest for belated payment would not be paid within a period of two months, as per the undertaking. As the respondents has failed to stand their words, the petitioner has filed this petition.
2. Today, the learned standing counsel appearing for the respondents filed an affidavit, wherein it is stated that the interest for the belated payment has been made on 11.04.2018 with delay and they also sought for unconditional apology for the delay.
3. The learned counsel appearing for the petitioner submitted that the order of this Court has been complied with and nothing survives for adjudication.
4. Considering the fact that the order of this Court has been complied with and the respondents have also sought for unconditional apology for the delay, no purpose would be served in reopening the Contempt Petition.
