For Respondent : Mr.R.M.S.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.122 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 457 and 397 IPC, in Crime No.122 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that on 11.04.2021, the defacto complainant was sleeping inside the house, the accused persons entered into the house and snatched away her thalli chain. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent and not committed any offence as alleged by the prosecution. The petitioner was implicated as accused, based on the confession statement of co-accused.
4.The learned Additional Public Prosecutor would submit that the petitioner is having previous cases of similar nature and that the investigation is not yet completed.

No.20609 of 2021 5.Considering the seriousness and gravity of offence alleged against the petitioner, the manner in which the offence is committed, custodial interrogation is required and due to bad antecedents of the petitioner, this Court is not inclined to enlarge the petitioner on anticipatory bail.
