PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned public auction notice 2016-2017, which published on 11.12.2016 vide daily Thanthi newspaper, passed by the respondent and consequently direct the respondent to fix the fair rent ot the shop old No.66, New No.46 in Block A which situated at daily market, Kovilpatti, Tuticorin District.

The auction notice issued by the respondent Kovilpatti Municipality in the year 2016 is challenged in this writ petition. 2.When this writ petition was taken up for hearing on 11.12.2023, there was no representation for the petitioner. Hence, this writ petition was ordered to be listed today under the caption for dismissal. Even today (13.12.2023), there is no representation for the petitioner. It was reported by the learned counsel for the respondent that the auction period is already over and the existing building was demolished and a new building has been constructed. 3.Since there is no representation for the petitioner and recording the submission made by the learned counsel for the respondent, this writ petition is dismissed for non-prosecution. No costs.
