This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents to reimburse the medical expenses of Rs.1,35,841/-, which is incurred by the petitioner for the surgery under the New Health Insurance Scheme 2022 (NHIS) by considering the representation of the petitioner dated 01.07.2025.
2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.The learned Counsel for the writ petitioner submits that the petitioner was employed as a Village Administrative Officer in the Revenue Department and has since retired from service. Owing to a urinary tract obstruction, he underwent surgery on 02.07.2024 and was discharged on 05.07.2024. In connection with the said treatment, the petitioner incurred a total medical expenditure of Rs.1,75,053/-. The relevant medical records were submitted to the third respondent - Insurance Company for reimbursement. However, the third respondent reimbursed only a sum of Rs.39,212/-. Aggrieved by the partial reimbursement, the petitioner sent a representation on 01.07.2015 seeking reimbursement of the remaining amount of Rs.1,35,841/-. As there has been no response from the respondents, the present writ petition has been filed. 4.
Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the third respondent to consider the representation of the petitioner dated 01.07.2015 and pass appropriate orders thereon, within a time frame to be fixed by this Court.
5.Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the third respondent, to consider the representation of the petitioner dated 01.07.2015 and pass appropriate orders in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the third respondent to consider the same on its own merits.
