PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the first respondent in P23/2/12328034/ADK dated 10.07.2023 and quash the same as illegal and consequently direct the respondents to disburse the retirement benefits, pension, etc., without any reduction or recovery.

O R D E R

This petitioner is a retired Headmaster. He has filed this writ petition challenging the communication of the Accountant General Office to the Joint Director, Kallar Reclamation in P23/2/12328034/ADK dated 10.07.2023. By this communication, certain queries have been raised by the Accountant General Office from the Joint Director, Kallar Reclamation, as to the entries made in the service book of this petitioner and he has raised an objection with regard to the personal pay paid to this petitioner along with multiplier. The above communication, dated 10.07.2023 is under challenge in this writ petition.

2.The learned counsel appearing for the Accountant General/the first respondent herein submits that this petitioner/Headmaster is entitled for a personal pay, however, it cannot be considered with multiplier. The order impugned in this 2/6

writ petition is only a communication, raising certain queries by the Accountant General. The petitioner shall offer his explanation to the Joint Director and the Joint Director, in turn, after scrutinization would submit his reply to the Accountant General. Therefore, there is no need to interfere with the impugned communication. 3.This Court considered the rival submissions made and also perused the materials placed on record.

4.The petitioner, who is a retired Headmaster of Government Kallar High School, Karukkattanpatti, Madurai has filed this writ petition challenging the communication of the Accountant General Office to the Joint Director, Kallar Reclamation, raising queries pointing out certain discrepancies in the service book of this petitioner with regard to personal pay of this petitioner. The order impugned in this writ petition is only an inter-departmental communication, which has been forwarded to the Joint Director. Moreover, it is only an objection raised by the Accountant General 3/6

with regard to the discrepancies pointed out from the Service Register of this petitioner.

5.In view of the above, this Court is not inclined to entertain this writ petition. The petitioner shall offer his explanation to the Joint Director and the Joint Director shall take a call on the objections made by the Accountant General after providing an opportunity to this petitioner and take a suitable decision with regard to the discrepancies pointed out by the Accountant General, within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the above directions, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
