The present Writ Petition is filed challenging the order passed by the second respondent in Appeal No.1/2016 dated 23.08.2016

2. When the matter came up for hearing, the learned counsel appearing on behalf of the petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to file a suit before the Civil Court. He also made an endorsement to that effect.

3. Hence, permission is granted and accordingly, this Writ Petition is dismissed as withdrawn with liberty to the petitioner to file a suit before the Civil Court in accordance with law. If the petitioner avails such remedy, the time spent in the Writ Petition shall be excluded while reckoning the period of limitation. No costs. Consequently, connected miscellaneous petitions are closed.
