RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition that the Petitioner shall appear before the Respondent Police daily at 6.00PM instead of morning 10.30 AM for a period of one month in connection with condition imposed in Crl.OP. (MD).No.16892 of 2021 dated 30.11.2021.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.D.S.HAROON RASHEED, Advocate for the petitioner and of Mr.M.VAIKKAM KARUNANITHI, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition that the petitioner shall appear before the respondent police daily at 06.00 p.m instead of daily 10.30 a.m for a period of one month in connection with condition imposed in Crl.OP(MD)No.16892 of 2021, dated 30.11.2021.
2. The learned counsel for the petitioner would submit that the petitioner is working as a Staff Nurse in the primary health centre at Pogalur, Ramanathapuram District, and her duty hours is 08.00 a.m to 05.00 p.m. Hence, she could not able to comply the above said condition. Hence, this petition.
3.Considering the limited request, made by the learned counsel for the petitioner, the condition 7(b) imposed in Crl.OP(MD)No.16892 https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.11877 of 2021 of 2021, dated 30.11.2021, is modified to the effect that the petitioner shall appear before the respondent police daily at 06.00 p.m for a period of one month and thereafter as and when required for interrogation and the other conditions shall remain unaltered. 4.Accordingly, this Criminal Miscellaneous Petition is allowed. sd/- 03/01/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
