Respondents Prayer :- Petition filed under Article 226 of the Constitution of India,to issue a Writ of Mandamus directing the respondents 3 & 4 to hand over the temple tank situated in SF.No.170/2 to an extent of 1 Acre, Vengur Village Panchayat, Thiruverumbur Taluk, Trichy District to Sri Ayyanar Sambugamoorthi Temple, Vengur Village Panchayat, Trichy District and further directing the respondents 1 & 2 to take appropriate action against the 4th respondent for unjust enrichment and misuse of temple tank by auctioning fishery rights to private individuals and to recover the amount collected through auctioning of fisheries right of the temple tank from the fourth respondent on the basis of the representation of the petitioner dt.3.1.2016., within a time frame fixed by this Court.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.Nihil Nandha, Advocate for the Petitioner and of Thiru. T.Amjadkhan, Government Advocate For Respondents 1 and 2, this Court made the following order: Read this in conjunction with and in continuation of final order made in the captioned main writ petition on 17.12.2021. Though the main writ petition was disposed of, the matter was directed to be listed under the caption 'FOR REPORTING COMPLIANCE'.
2. Today, Mr.Nihil Nandha, learned counsel representing the counsel on record for writ petitioner and Mr.T.Amjadkhan, learned Government Advocate on behalf of respondents 1 and 2 submit in one voice that respondents 3 and 4 have handed over said ponds to the second respondent, who is the jurisdictional Assistant Commissioner of TN HR&CE Dept. In other words, it is the common say of learned counsel for writ petitioner and learned State Counsel that the positive directive qua 17.12.2021 order in the captioned main writ petition has been duly complied. This position is recorded.
