The Criminal Miscellaneous Petition has been filed seeking orders to condone the delay of 88 days in filing the Criminal Appeal challenging the judgment of conviction made in Spl.S.C. No.44 of 2024 on the file of the learned Special Court for Exclusive Trial of cases under POCSO Act, Dindigul, dated 29.01.2025.
2.In response to the notice, the defacto complainant appeared in person and raised objections to condone the delay.
3.Heard both sides and also perused the records.
4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 88 days in filing the Criminal Appeal, is condoned and accordingly, this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order.
