The Writ Petition is filed seeking a direction to the respondents to sub divide the property in Old S.No.152/7, New S.NO.152/22 A to an extent of 53 cents respectively situated at Keelappaungudi Village, Sivagangai Taluk, Sivagangai District and thereafter issue separate patta to the Petitioner's father's name within the time stipulated by this Court. 2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 and 2. By consent of both parties,the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, the subject property was purchased by his father Manickam under registered sale deed, dated 30.5.1994. He died on 9.12.2020 leaving behind the Petitioner and other legal heirs. The Petitioner submitted a representation on 30.3.2023 before the second respondent seeking sub division of the property purchased by his father. The same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra. 2/5
4.Mr.A,Baskaran, learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that the Petitioner failed to upload the legal heirship certificate and death certificate of his father along with his application. Therefore there is difficulty in considering his application on merits. 5.In view of the same, without expressing any opinion on the merits of the matter, the Petitioner is directed to submit the legal heirship certificate and death certificate of his father within a period of two weeks from the date of receipt of a copy of this order. On submission of those documents, the second respondent is directed to consider the application submitted by the Petitioner, dated 30.3.2025 and pass final orders on its own merits after issuing notice to the Petitioner, other legal heirs of Manickam and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
