(Order of the Court was made by T.S.SIVAGNANAM, J) Heard Mr.P.Athimoolapandian, learned counsel appearing for the petitioner and Mr.A.Muthu Karuppan, learned Additional Government Pleader appearing for the respondents.
2.By consent of both parties, the writ petition is taken up for final disposal.
3.The petitioner is an Association registered under the provision of the Tamil Nadu Societies Registeration Act, 1978, stated to consist of persons belonging to Malaivedan Community. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Writ Petition (MD).No.23215 of 2019 4.It appears that the Association has made an application to the second respondent for grant of Malaivedan community certificate in respect of its members, which was rejected and therefore, the petitioner Association seeks for a direction upon the respondents to dispose of their representation and take note of the earlier proceedings issued by the first respondent, the Chairman of District Vigilance Committee, Dindigul.
5.In our considered view, the prayer sought for by the petitioner is parallelly misconceived. A person who seeks for a community certificate stating that he belongs to a particular community has to establish the same. There cannot be no blanket order at the instance of the Association that its members, whoever their representatives should be granted community certificate belonging to the particular community. Thus, the prayer sought for is wholly not maintainable.
