... Respondent/Complainant For Petitioner : M/s.Balaji S, Advocate For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.181/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 427, 506(i) I.P.C, in Crime No.181 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 12.09.2022, at about 03.00PM, the accused abused, assaulted the defacto complainant and also criminally intimidated him. He also caused damages to the mudpot, to the tune of Rs.300/-. Hence, the complaint.

3. On the side of petitioner, it is stated that the petitioner is innocent and no way connected with the offence. There was petty

dispute between the parties, over which, a false case was foisted against him. Hence, prays to release the petitioner on anticipatory bail.

4.On the side of prosecution, it is stated that the injured was discharged from the hospital and that the petitioner is not having any bad antecedent to his credit. In this case investigation is not yet completed. Hence, prays to dismiss the petition. 5.Considering the money dispute between the parties, considering the fact that the injured was discharged from the hospital, that the petitioner is not having any previous case, this Court is inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the Judicial Magistrate No.II, Sattur, on condition that the petitioner shall execute a bond for a sum of Rs.

(b)the petitioner shall report before the respondent police daily at 10:30 am until further orders;

(c)the petitioner shall not tamper with the evidence or witness either during investigation or trial;

(d)the petitioner shall be present before the Court on hearing dates and before the respondent police as and when required; (e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law, as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f)if the accused/ petitioner thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
