ORDER
This Criminal Original Petition has been filed to direct the second respondent to execute the Non-Bailable Warrant dated 01.04.2019, issued by the learned Judicial Magistrate, Paramakudi in S.T.C.No.1184 of 2013 as against the third respondent. 2.The learned counsel for the petitioner submitted that the petitioner lodged a complaint against the third respondent for the offence punishable under Section 138 and 142 of Negotiable Instruments Act in S.T.C.No.1184 of 2013 on the file of the learned Judicial Magistrate Paramakudi.
3.The learned Judicial Magistrate Paramakudi, after conducting the trial, convicted and sentenced the third respondent to undergo four months simple imprisonment along with compensation. As against https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL.O.P.(MD).No.17412 of 2019 which, the third respondent preferred an appeal in C.A.No.5 of 2016 and the same was dismissed on 18.02.2019, by the learned Additional District Court at Paramakudi. Thereafter, he did not file any appeal till today.
4.Considering the facts and circumstances of the case, the second respondent is directed to execute the Non Bailable Warrant issued as against the third respondent in S.T.C.No.1184 of 2013, dated 10.03.2016 within a period of four weeks form the date of receipt of a copy of this order. The petitioner is also directed to co-operate with the second respondent to furnish the correct address of the third respondent to execute the non bailable warrant.
