Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the official respondents 1 to 6 to take necessary action against the seventh respondent for ex-communicating the petitioner and his family from Sivanthipatti Hindu Nadars Uravinmurai on the basis of the petitioner's representation dated 09.09.2024.

ORDER

This writ petition has been filed seeking orders to direct the official respondents 1 to 6 to take necessary action against the seventh respondent for ex-communicating the petitioner and his family from Sivanthipatti Hindu Nadars Uravinmurai on the basis of the petitioner's representation dated 09.09.2024.

2.Mr.M.Muthumanikkam, learned Government Advocate(Civil Side) takes notice for the respondents 1 to 3 and Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 4 to 6. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3.When the matter is taken up for hearing today, the learned counsel on either side would submit that one Vadivel has filed a similar petition in W.P.(MD)No.22997 of 2024 and this Court, taking note of submission made by the learned Additional Public Prosecutor and the Government Advocate(Civil side) that the matter is pending before the third respondent therein, had directed the third respondent to consider the petitioner's representation by giving notice to the petitioner and the seventh respondent and other involved persons and take a decision on 26.09.2024 itself, since temple festival was scheduled on 28.09.2024. 4.The learned Government Advocate(Civil Side) appearing for the respondents 1 to 3 would submit that the third respondent has not 3/6

conducted any meeting on 26.09.2024 as he was occupied with some other work and that he has fixed meeting on 02.10.2024. 5.The learned counsel appearing for the petitioner would submit that the petitioner in the earlier petition is representing one family and the petitioner in the present petition is representing another family and that the temple authorities have refused to collect temple tax from them. 6.Recording the submissions made on either side, the third respondent is directed to issue notice to the petitioners in both writ petitions and the seventh respondent and other persons involved in the temple issue, conduct enquiry and take a decision tomorrow (02.10.2024) itself.
