ORDER

This Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders, to direct the second respondent not to harass the petitioners in the guise of enquiry.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that the second respondent has registered an FIR in Crime No.181 of 2024 against the first petitioner for the alleged offence under Section 4(1)(c), 4(1)(A) TNP (Amendment) Act 2024 (Transport). He would further submit that the police went to the house for searching the first petitioner and hence, the above petition came to be filed.

3. The learned counsel for the petitioners would submit that though the first petitioner is ready to surrender before the concerned Court, the respondent threatened them that they would arrest the petitioners 2 to 4 including the pregnant women.

4. Since FIR came to be registered against the first petitioner, the question of granting relief to him at this stage does not arise. But at the same time, the respondent police is directed not to harass the family members of the first petitioner and they are at liberty to arrest the first petitioner in the manner known to law.

5. With the above direction, this Criminal Original Petition is disposed of.
