ORDER

The petitioner / A1, who was arrested and remanded to judicial 1/5

custody on 27.06.2024 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, in Crime No.259 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 26.06.2024 at about 11.30 pm, on the secret information, the respondent police went to the place of occurrence at Nagamalaipudukkottai, Thuvariman, nearby Kanmoikarai, and intercepted a car bearing Reg.No.KL-37-A-1465. On searching, the accused were found in illegal possession of 25 kg of ganja. Hence the case.

The learned counsel appearing for the petitioner would submit that the petitioner is innocent and she was falsely implicated in this case and she has not committed any offence as alleged by the prosecution. He would further submit this is the second bail petition. The earlier petition filed by the petitioner was withdrawn by her and she has been arrested and remanded to judicial custody on 27.06.2024. Therefore, prayed to grant bail for the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent strongly opposed to grant bail to the petitioner on the ground 2/5

that the quantity involved in this case is a commercial quantity and the offence is grave in nature. Further, after completion of investigation, final report was filed before the 1st Additional Special Court for NDPS Act Cases, Madurai, and the same was taken on file in C.C.No.457 of 2024 and the case was posted to 08.04.2026 for examination of the Investigating Officer.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity involved in this case is a commercial quantity and there are no change of circumstance and the petitioner has failed to satisfy the conditions contemplated under Section 37 of the NDPS Act and already trial was commenced and the case was posted to 08.04.2026 for examination of the Investigating Officer, this Court is not inclined to grant bail to the petitioners.

7. Accordingly, this Criminal Original Petition stands dismissed. 3/5

8. Considering the pendency of the case, 1st Additional Special Court for NDPS Act Cases, Madurai, is directed to complete the trial in C.C.No.457 of 2024 as expeditiously as possible without granting adjournment beyond one week.
