ORDER
The petitioner is facing trial in SC.No.511 of 2017 on the file of the V Additional Sessions Court, Madurai. He was arrested pursuant to a non-bailable warrant of 1/5
arrest issued as against him on 02.08.2024 and he is in jail for the past 12 months. Therefore, he moved this petition seeking bail. 2.When this application came up for hearing today, learned Counsel for the petitioner sought an adjournment. However, learned Government Advocate raised serious objections for this application that this petitioner is an rowdy element, having a history sheet in HS.No.1 of 2017 on the file of the Thirunagar Police Station. According to the learned Government Advocate, the petitioner is having 17 previous cases to his credit, of which, three relate to murder cases and two relate to attempt to murder cases.
3.Learned Government Advocate further submitted that the petitioner was secured on 02.08.2024, pursuant to the non-bailable warrant of arrest issued as against him on 19.06.2024. This non-bailable warrant, according to the learned Government Advocate, was issued by the trial Court for the third time. The petitioner has evaded the trial on 15.06.2022, for which, a non-bailable warrant of arrest was issued as against him on 04.10.2023. Again, he absconded on 20.10.2023, for which, another non-bailable warrant of arrest was issued as against this petitioner. In the meantime, he was secured in connection with another case in Crime No.762 of 2024 and he was produced on PT warrant on 15.03.2024. For the third time, he absconded on 19.06.2024 and he was secured on 02.08.2024. 2/5
4.This Court considered the submissions made by the learned Government Advocate (Crl. Side). The petitioner's Counsel is not having any valid reason for taking time.
5.The materials placed by the learned Government Advocate (Crl. Side) is sufficient to show that the petitioner is not only a habitual offender and history sheeter, but also evaded the trial thrice. It appears that with great difficulty, the respondent Police has secured him. It is reported that the petitioner is having 17 previous cases to his credit and therefore, releasing the petitioner on bail would certainly affect the course of trial.
6.Considering the manner in which the petitioner has evaded the trial thrice and also considering his antecedents, this Court is not inclined to grant bail to the petitioner. Accordingly, this original petition stands dismissed. 7.Since this bail application is dismissed, the trial Court is expected to conclude the trial in SC.No.511 of 2017 as expeditiously as possible, preferably within a period of six months.

8.Mere registering a history sheet is not sufficient. Considering the number of cases pending as against the petitioner, the Commissioner of Police, Madurai City, shall ensure that the final reports are filed in all the cases pending as against the petitioner and that the trials in all the cases are proceeded with. Since the petitioner is in jail, this Court is issuing this general direction to the Commissioner of Police, Madurai City and to the Chief Judicial Magistrate, Madurai, who shall instruct the respective Police and Judicial Magistrates, where the cases and trials pertaining to the petitioner are pending, to produce the witnesses and to conclude the proceedings as expeditiously as possible, preferably within a period of six months. sd/- 28/08/2025 / TRUE COPY / /2025 Sub-Assistant Registrar ( C.S.
