Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, for the issuance of a writ of mandamus, directing the respondent to pay the petitioner's terminal benefits towards gratuity amount, which was recovered by the respondent and Labour fund, welfare fund, medical and engineering college fund amount within the stipulated time frame as may be fixed by this court and pass orders.

ORDER

The petitioner, who has superannuated on 30.04.2017 seeks a mandamus directing the employer, The Tamil Nadu State Transport Corporation to pay him his terminal benefits towards gratuity that were recovered by the respondent as well as Labour, Welfare, Medical and Engineering College funds, within a time frame to be fixed by the court.

2. On the earlier occasion, I had recorded that the respondent counsel had not disputed the position that the retirement benefits had not been settled in full and had called upon both parties to quantify the amount remaining as per their calculation.

3. Both of them have filed memos dated 22.12.2021, wherein the balances remaining unpaid do not tally.

4. Thus and without going into the factual aspects of quantification of the amounts, it would be appropriate that a direction be issued to the respondent to dispose the representation https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No. 18740 of 2018 dated 22.08.2018 filed by the petitioner seeking identical benefit as sought for in this writ petition, after hearing him such direction as aforesaid is issued.
