JUDGMENT

(Judgment of the Court was made by G.R.Swaminathan J.) Heard both sides.

2.The petitioner challenged the order dated 20.09.2021 passed by the Joint Commissioner, HR&CE Department, Madurai in O.A.No.10 of 2021 by filing W.P(MD)No.15763 of 2022. It was dismissed on the ground that the writ petitioner can avail the appeal remedy. Challenging the same, this Writ Appeal came to be filed.

3.During the pendency of the Writ Appeal, the other aggrieved individuals had filed an appeals before the Commissioner of HR&CE in A.P.No.37 of 2023 and A.P.No.11 of 2024. The said appeals were allowed by the Commissioner on 10.03.2025 and the matter has been remanded to the file of Joint Commissioner, HR&CE, Madurai to pass an order afresh.

4.Since the order impugned by the appellant had already been set aside, nothing survives for further adjudication in this Writ Appeal. The appellant may of course file an impleading application in O.A.No.10 of 2021.

5.With the aforesaid liberty, this Writ Appeal is disposed of as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
