Mr.B.Nambiselvam Additional Public Prosecutor PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1330 of 2023 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 420 and 506(1) of IPC, in Crime No.1330 of 2023, on the file of the respondent police, seeks anticipatory bail. 1/3
2. The case of the prosecution is that the defacto complainant lodged a complaint stating that he is working as a branch manager in Intel-Money Limited. Accused Nos.1 and 2 were their customers. He used to introduce them to known persons. There was a mutual agreement between the parties. In the course of understanding, one Balaji was introduced stating that he has pledged 500 grams of jewels with the second accused. So that he has demanding the exorbitant interest, he wanted to redeem the jewel and repledge the same. The defacto complainant believing the words handed over a sum of Rs.23 Lakhs to the first accused, in turn the same was handed over to the second accused. He has neither returned the money nor redeemed the jewels. Hence the present case came to be registered.
3. The learned counsel for the petitioner would submit that she is an innocent, she has not committed any offence as alleged by the prosecution and she has been wrongly implicated in this case.
4. Learned Government Advocate (Crl.side) would submit that during the course of enquiry it revealed that the petitioner has involved in similar case in Crime No.14 of 2016 on the file of the AWPS Goldenrock police Station. Apart from that other cases are pending against the petitioner /second accused herein. No amount was recovered and the first accused is still absconding.
5. Eventhough, it has been stated that this petition has not received any amount 2/3
from the defacto complainant, considering the fact that the petitioner is a habitual offender, he is not entitled for any discretionary relief.
