ORDER
The petitioner herein seeks a direction to the fourth respondent to issue patta in his name in respect of the property situated in Natham Survey No.36, New Survey No.876/24, Puthupattai Village, Alangulam Taluk, Tenkasi District, by considering his representation dated 26.06.2025.
2.Heard the arguments of Mr.T.Thirumurugan, learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, the subject property was purchased by him on 03.06.2013 from his father and two others, namely, Nalini and Sundar Raj. Since patta for the subject property is not in the name of the petitioner, he submitted a representation on 26.06.2025 before the official respondents seeking issuance of patta. The first respondent in his proceedings in Oo.Mu.COLR/7897/2025-13, dated 22.07.2025 forwarded the representation of the petitioner to the fourth respondent with a direction to consider his representation in accordance with law. Thereafter, the fourth respondent has not considered the same. Therefore, the petitioner has come before this Court. 4.The learned Government Advocate appearing for the respondents would submit that the representation of the petitioner will be considered in accordance with law.
5.A perusal of the typed set of papers would indicate that the petitioner has not purchased the subject property and only his father, Rajendran purchased the property on 03.06.2013 from Nalini and
Sundar Raj. Hence, the request of the petitioner for issuance of exclusive patta in his name cannot be considered without ascertaining the views of other legal heirs of Rajendran.
6.In view of the same, without expressing any opinion on the merits of the matter, the fourth respondent is directed to consider the representation of the petitioner dated 26.06.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, legal heirs of Rajendran and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
