O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to rectify the mistake that has crept into Patta No.837 in respect of the properties situated at Kandiyanatham Village, Thirumayam Taluk, Pudukkottai District, on the basis of the petitioner's representation dated 05.05.2018.

2. The grievance of the petitioner is that the properties comprised in S.F.Nos.64/2, 65/1, 66/1, 182/6, 183/7, 189/1 and 189/3, measuring a total extent of 3.39.1 hectares, were assigned by the Pudukottai Diwan in favour of the petitioner's grandfather for performing poojas in Kandiyanatham Kuravalikkattur Ayyanar Temple and Viralimalai Murugan Temple. The petitioner's grandfather, thereafter the petitioner's father and subsequently the petitioner have been in continuous possession and enjoyment of the said properties.

However, during the Settlement Scheme, the patta was erroneously transferred in the name of the petitioner's father and 13 others, who are neither related to the petitioner's family nor connected with the temple. Though the petitioner submitted various representations to the respondents, no action has been taken. The petitioner finally submitted a representation dated 05.05.2018, which also did not evoke any response. Therefore, the petitioner has been constrained to file the present Writ Petition.

The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representation dated 05.05.2018 is still pending consideration; and that the same would be considered and appropriate orders would be passed by the first to third respondents within a period of eight weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first to third respondents to consider the petitioner's representation dated 05.05.2018 and pass appropriate orders on its merits and in accordance with law within a period of eight weeks from the date Page No. 3 of 5

of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The first to third respondents are also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order.
