Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus, to call for the records pertaining to the impugned report of the 2nd respondent dated 24.09.2024 and quash the same as illegal and consequently direct the respondents to conduct survey in her property in S.No.377/3, Sathurveda Mangalam, Singapuneri Taluk, Sivagangai District in the presence of the petitioner within time stipulated by this Court.

ORDER

The Writ Petition is filed challenging the survey report of the second respondent dated 24.09.2024.

2. When the Writ Petition is taken up for hearing, the learned counsel appearing for the petitioner would submit that the petitioner is not pressing the writ prayer and the petitioner is ready to file a fresh application for conducting re-survey of the subject property. The said representation made by the learned counsel for the petitioner is recorded. He has also made an endorsement to that effect.

3. In view of the same, the Writ Petition is disposed of by directing the petitioner to file a fresh application seeking re-survey of the subject property within a period of two (2) weeks from the date of receipt of a copy of this order. If any such application is filed, the same shall be considered by the first respondent in accordance with law and final orders shall be passed within a

period of eight (8) weeks from the date of receipt of such application. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
