PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, Certiorarified Mandamus, calling for the records of the impugned notices in Letter No. A3/3223/2021 dated 02.08.2023 passed by the fourth respondent to grant, quash the same and consequently, directing the fourth respondent to grant sufficient period of breathing time for one year to the petitioners for clearing the arrears EMI amount in respect of the petitioners property situated at HIG 1-6 and MIG 1-6, TNHB, Chinnalapatthy, Dindugul 624 301 on the basis of the petitioner's representation dated 29.07.2023 and 02.08.2023.

The petitioner, an allottee of a house allotted by the Tamil Nadu Housing Board has filed this writ petition as against the order calling upon the petitioner to pay a sum of Rs.11,70,400/- as arrears towards installments.

2.The learned counsel appearing for the petitioner submits that due to COVID-19 pandemic, the petitioner could not make payment at that relevant point of time. Hence, it accumulates to Rs.11,70,400/- as arrears. The petitioner is now prepared to pay the amount in easy installments and he is ready to pay a sum of Rs.1,00,000/- within two weeks.

3.Considering the request made by the petitioner, this writ petition is disposed of with a direction to the petitioner to pay a sum of Rs.1,00,000/- within a period of two weeks from the date of receipt of a copy of this order along with an affidavit of undertaking 3/6

stating that the time for payment of remaining dues and the same shall be considered by the respondent Board and some easy installments may be provided to this petitioner to clear the dues. No costs.
