Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus forbearing the respondents 1 to 5 from unlawfully laying the cement stone pilliar with metal wire fence in the existing vacant site measuring to an extent of twenty three cents (0.23) out of Fourty Seven(0.47) cents in S.F.No.1883/24, (Old S.F.No. 1750/B, Kambiliyanpatti Village No. 79, Dindigul East Taluk, Dindigul District wherein the Shri Selva Vinayagar and Shri Devi Karimariyaman Thirukovil are located and directing the 6th respondent/Police to provide adequate police protection to the petitioner for entering into above said two temples and for participating the temple festival by considering the petitioner's representation dated 24.08.2023 and consequently directing the respondents 2 to 4 to supervise the smooth functioning of the yearly festival celebration conducted in both temples without any discrimination.

This Writ Petition is filed seeking a Writ of Mandamus forbearing the respondents 1 to 5 from unlawfully laying the cement stone pilliar with metal wire fence in the existing vacant site measuring to an extent of twenty three cents (0.23) out of Fourty Seven(0.47) cents in S.F.No.1883/24, (Old S.F.No.1750/B, Kambiliyanpatti Village No. 79, Dindigul East Taluk, Dindigul District, wherein the Shri Selva Vinayagar and Shri Devi Karimariyaman Thirukovil are located and directing the 6th respondent/Police to provide adequate police protection to the petitioner for entering into above said two temples and for participating the temple festival by considering the petitioner's representation dated 24.08.2023 and consequently directing the respondents 2 to 4 to supervise the smooth functioning of the yearly festival celebration conducted in both temples without any discrimination.

2. The petitioner has made a representation on 24.08.2023 before the first respondents, requesting to prevent the respondents 2 to 5 3/6

from unlawfully laying the cement stone pilliar with metal wire fence in the subject property. Since the said representation has not been considered till date, the petitioner has filed this Writ Petition.

3. The learned Government Advocate appearing for the respondents 1 to 5 would submit that the representation of the petitioner dated 24.08.2023 would be considered in accordance with law.

4. Considering the facts and circumstances of the case, this Court, without going into the merits of the claim made by the petitioner, directs the second respondent to consider and pass orders on the representation of the petitioner dated 24.08.2023, on merits and in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
