ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to cancel the wrongful sub division and issue a separate patta in the name of the petitioner with respect to the property comprised in Survey No. 636/1A, Ambalapattu South Village, Orathanadu Taluk, Thanjavur District, based on the petitioner's representation dated 12.08.2024.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, he is the rightful owner of the property comprised in Survey No.636/1A, Ambalapattu South Village, Orathanadu Taluk, Thanjavur District. A wrongful and improper sub-division has been carried out in respect of the said property, adversely affecting the petitioner's title and enjoyment of the land. Therefore, the petitioner submitted a detailed representation dated 12.08.2024 to the respondents seeking cancellation of the erroneous sub-division and issuance of a separate Patta in his name. The

respondents have failed to consider or act upon the representation, compelling the petitioner to approach this Court. Hence, the present Writ Petition.

4. The learned Additional Government Pleader appearing for the respondents 1 and 2 submits that the petitioner's representation will be considered on its merits and in accordance with law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 1 and 2 to consider the petitioner's representation dated 12.08.2024 on its merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The respondents 1 and 2 are directed to provide reasonable opportunity during such enquiry to the petitioner, the third respondent and also to the others who may be affected by such decision. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
