COMMON ORDER : The Court made the following order :- The petitioner /Accused who was arrested and remanded to judicial custody on 17.08.2023, for the alleged offences under Sections 294(b), 506(ii) and 386 of IPC altered into Sections 294(b), 506(ii) and 386 of IPC r/w 25 (1-A) of Indian Arms Act in crime No.243 of 2023, and for the offences under Sections 147, 148, 294(b), 324 and 506(ii) of IPC and Section 25(1-A) of Indian Arms Act, in Crime No.152 of 2023, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner has threatened the defacto complainant with deadly weapon and try to snatch Rs.300/- from the defacto complainant's pocket and hence a case in Crime No.243 of 2023 was registered. On 14.05.2023, the petitioner alleged to have called the defacto complainant to come to the occurrence spot and there the petitioner attacked him with wooden log and deadly weapon. Hence a case in Crime No.152 of 2023 came to be registered.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that a proposal for detention of the accused has been sent and the same is pending before the District Collector, Thanjavur District. 2/3
5. In view of the submissions made by the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. Depending upon the outcome of the proposal, the petitioner can revive his application at the appropriate time.
