ORDER: The Court made the following order :- The petitioners, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 468, 471, 420 & 120B of IPC and Section 5 of TNPID Act, 1997, in Crime No.7 of 2022, on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that one Chandra has preferred a complaint before the respondent Police as against one financial establishment namely, New Raise Alayam situated at Karaikudi and others alleging that she along with her relative deposited a sum of Rs.35 lakhs, for which, she was issued with bonds by the said financial establishment. However, the amount was not refunded to the de-facto complainant after maturity period. Further, it is alleged that while she met the Chairman of the said company, she was told that some of the funds have not been paid to the company by the collecting agents and evaded the de-facto complainant. Therefore, an FIR came to be registered in Crime No.7 of 2022 for the offences punishable under Sections 406, 468, 471, 420 & 120B IPC and Section 5 of TNPID Act, 1997. The petitioners are arrayed as an accused on the basis of confession given by the co-accused. Hence, the apprehension of arrest. Hence, a case has been registered as against the petitioners.

3.The learned counsel appearing for the petitioners submitted that they have been falsely implicated in this case and they have not committed any offence. He further submitted that the 2nd petitioner Veerappan is 71 years old. He seeks this Court to grant anticipatory bail to the petitioners. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that the offences committed by the petitioners are serious in nature. 5.This Court had already granted interim anticipatory bail and directed the petitioners to appear before the respondent police. The prosecution, after investigation, has submitted that the petitioners circulated the document details relating to the properties on 25.10.2025. The petitioner shall submit all the documents relevant to the said properties to the Investigation Officer.
The said compliance shall be reported before the concerned Judicial Magistrate concerned at the time of producing sureties. In view of the above, the interim anticipatory bail already granted is made absolute and this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
6. Accordingly, this Petition is allowed and the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of 3/6
fifteen days from the date of receipt of a copy of this order, before the Special Court for TNPID Act Cases, Madurai, on condition that the first petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the respondent Police or to the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further conditions that: (a) the first petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioners shall report before the respondent police as and when required for investigation. The petitioners shall not alienate, encumber or deal with the said properties in any manner; (c) the petitioners shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioners shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned 4/6
Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f) if the accused thereafter abscond, a fresh FIR can be registered under Section 269 of BNS 2023.
