O R D E R

This writ petition has been filed seeking to quash the impugned order passed by the second Respondent bearing Reference No.LD2P1/5661 dated 13.06.2025.

2. The punishment imposed on the petitioner had been held that the period of absence should be treated as unauthorised absence. Against which, the petitioner preferred an appeal before the first respondent. The first respondent without considering the claim of the petitioner on merits had taken the past punishments imposed upon the petitioner dismissed 2/5

the appeal. Such decision in the appeal by taking into the past punishment imposed on the petitioner, without considering the appeal on merits is unjustified.

3. In view of the same, the impugned order dated 13.06.2025 is set aside and the appeal filed by the petitioner is remitted back to the first respondent. The first respondent shall consider the same and pass appropriate orders on merits and in accorance with law within a period of eight weeks from the date of receipt of a copy of this order.

4. In fine, the writ petition stands allowed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 04.11.2025 NCC:yes/no Index:yes/no Internet:yes/no Sn 3/5
