PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to give permission to the petitioner to organize Annadhanam at about 01.00 PM and Valli Thirumanam Drama at about 10.00 PM on 18.09.2023 at Sethurappatti Village, Thirumayam Taluk, Puthukkottai District with light and sound by considering the petitioners representation dated 08.09.2023. This Writ Petition is filed under Article 226 of the Constitution of India seeking for a mandamus to the respondent Police to give permission to the petitioner for organizing Annadhanam at about 01.00 PM and Valli Thirumanam Drama at about 10.00 PM on 18.09.2023 at Sethurappatti Village, Thirumayam Taluk, Puthukkottai District.
2. It is submitted by learned counsel for the petitioner that except one family, the entire village is in favour of conducting the festival and basing on the objections of the said family, the respondent Police have not granted permission so far.
3. Learned Government Advocate (Criminal Side), on the other hand, submits that, a Peace Committee Meeting was conducted and as per the outcome of the Peace Committee Meeting, the respondent Police were advised by the Tahsildar that on account of dispute between the parties if both parties appeared before the Court and he has requested the respondent Police to give permission.
4. Considering the circumstances, keeping in view of the fact that the programme is scheduled only on 18.09.2023, the petitioner is directed to 2/4
approach the respondent Police along with the rival parties and on such appearing before the respondent Police, if both of them jointly intending to celebrate the festival, the respondent Police are directed to grant permission by imposing usual conditions.
5. With the above direction, this Writ Petition is disposed of. No costs.
