Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, directing the respondents 1 to 4 to grant adequate police protection for quarrying gravel in the lands in Survey Nos. 226/8 measuring 0.17.00 Hectares, 232/1B measuring 0.54.50 hectares, 232/4B measuring 0.34.75 Hectares and 232/5 measuring 0.21.00 Hectares at Mustakurichi Village, Kariapatti Taluk, Virudhunagar District as per the licence granted by the Assistant Director of Mines and Minerals, Mines and Minerals Department, Virudhunagar in Na.Ka.No.KV3/869/2021 dated 13.12.2021.

This writ petition is filed for a Writ of Mandamus, directing the respondents 1 to 4 to grant adequate police protection for quarrying gravel sand from his patta land as per the licence granted by the Assistant Director of Mines and Minerals, Mines and Minerals Department, Virudhunagar in Na.Ka.No.KV3/869/2021 dated 13.12.2021.

The learned counsel for the petitioner submitted that the petitioner have applied the licence to quarry gravel from his patta land to the Assistant Director of Mines & Minerals, Mines and Minerals Department, Virudhunagar District and the licence was granted in Na.Ka.No.KV3/869/2021 dated 13.12.2021 and the permit is valid for a period of 12 months from 13.12.2021. On 13.12.2021, the petitioner started quarrying gravel, at that time, the fifth respondent along with some of his henchmen threatened the petitioner. Therefore, the petitioner made a complaint on 19.12.2021, seeking police protection and the same was not considered so far. Hence, this Writ Petition has been filed.

3. The learned Additional Public Prosecutor appearing for the respondent police 1 to 4 submitted that the licence was granted to the petitioner only for 12 months from 13.12.2021 and the said period was already over.
