PRAYER: This Petition filed under Article 227 of the Constitution of India to allow the Civil Revision Petition and set aside the fair and decreetal order dated 20.09.2019 made in E.P.No.01 of 2018 in I.A.No.87 of 2016 in D.O.P.No.170 of 2014 on the file of the I Additional District Court, Tirunelvelil.

This Civil Revision Petition has been filed against the fair and decreetal order passed in E.P.No.01 of 2018 in I.A.No.87 of 2016 in 1/4
D.O.P.No.170 of 2014, dated 20.09.2019, on the file of the I Additional District Court, Tirunelveli,.
2. The learned counsel appearing for the revision petitioner would submit that the application in I.A.No.87 of 2016 was filed for handing over the original passport of the husband / respondent and in the said proceedings, an order came to be passed which resulted in filing of E.P.No.1 of 2018 seeking arrest of the revision petitioner herein and the same has already been ordered. However, the learned counsel for the revision petitioner states that in view of the subsequent development, this Court while passing orders in Civil Miscellaneous Appeal proceedings, has reversed the finding of the I Additional District Judge in DOP.No.170 of 2014 and granted divorce to the husband / respondent and the passport has already been returned and nothing remains to be adjudicated in the present Civil Revision Petition.
3. The learned counsel appearing for the respondent / husband is also present before this Court and he submits that he has no instructions from his client.

4. Recording the submissions of the learned counsel appearing for the revision petitioner, this Civil Revision Petition stands closed. However, reserving liberty is given to the revision petitioner to reopen the present Civil Revision Petition, in the event of the husband / respondent proceeding further with the arrest through execution proceedings. No costs.
