For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 74 of 2021 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120, 420, 465 IPC in Crime No.74 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with A1 to A3 have created forged document in respect of the property of the de-facto complainant and tried to construct a building. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, the learned counsel seeks for anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis
4.The learned Government Advocate (criminal side) appearing for the respondent police would submit that in this case, the accused created a forged document, hence, custodial interrogation is necessary. He would further submit that in this case, investigation is not completed. Hence, he has strongly opposed to grant anticipatory bail to the petitioner 5.Considering the facts and circumstances of the case and also considering the nature of the offence and also considering the fact that the investigation is not yet completed, this Court is not inclined to grant anticipatory bail to the petitioner at this point of time.
