ORDER
The writ petition is filed seeking a direction to the second respondent herein to dispose of the appeal dated 11.08.2025, filed by the petitioner for cancellation of the Patta stands in the name of the fifth respondent (wrongly mentioned in the prayer as third respondent) and for restoration of the patta in the names of all nine legal heirs of Late.Yagappan within the time frame fixed by this Court. 2.Heard the arguments of Mr.R.Mohamed Riyaz, learned counsel appearing for the petitioner, Mr.A.Baskaran, learned Additional
Government Pleader appearing for the respondents 1 to 4 and Mr.V.G.Vallarasu Chezhiyan, learned counsel appearing for the fifth respondent. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself. 3.According to the petitioner, the subject property originally belongs to his father, Yagappan and he died on 17.04.2023. As per the legal heirship certificate issued by the fourth respondent, there are six surviving legal heirs to the father of the petitioner including the petitioner and the husband of the fifth respondent, Arockiyasamy. After death of petitioner's father, the fifth respondent got transfer of patta in her name excluding the other legal hairs in Patta No.4864. Therefore, the petitioner filed an appeal on 11.08.
2025 before the fourth respondent and also marked a copy of the representation to the third respondent by registered post. The representation of the petitioner has not been considered till date. Therefore, he has come before this court. 4.

5.The learned counsel for the fifth respondent would submit that the patta in favour of the fifth respondent was issued by the fourth respondent based on the settlement deed executed by her husband, Arockiyasamy and a Will executed by the above mentioned Yagappan. 6.In view of the rival contention raised by the petitioner and the fifth respondent, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the appeal filed by the petitioner dated 11.08.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, fifth respondent and other legal heirs of deceased, Yagappan. Accordingly, this Writ Petition is disposed of. No costs.
