Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned appointment order in R.C.N6/231/15, dated 19.02.2016 issued by the 1st respondent infavour of the 4th respondent to the post of Noon Meal 1/4

Organizer in the 3rd respondent school and quash the same and consequently direct the 1st respondent to appoint the writ petitioner in the post of Noon Meal Organizer in 3rd respondent school.

ORDER

This writ petition is filed challenging the appointment order, dated 19.02.2016 issued to the 4th respondent.

2. Heard Mr.AN.Ramanathan, learned counsel appearing for the petitioner and Mr.P.Thambidurai, learned Government Advocate, appearing for the respondents. Perused the material documents available on records.

3. The petitioner has participated in the selection process. The respondents have come to the conclusion, based on the age of both the writ petitioner as well as the 4th respondent and also based on the merits. The reasons stated by the respondents is that the 4th respondent is aged about 39 years, whereas the petitioner is aged about 37 years. Both the petitioner as well as the 2/4

4th respondent are Scheduled Caste Community. Since the 4th respondent would cross the age of consideration the respondents have decided to grant an appointment to the 4th respondent.

4. This Court convinced about the reason to select the 4th respondent. Therefore, this Court is not inclined to entertain this writ petition.
