(Order of the Court was made by G.K.ILANTHIRAIYAN,J.) This petition has been filed to condone the delay of 135 days is filing the above Civil Miscellaneous Appeal.

2.This Court by an order dated 16.10.2025 allowed the condone delay petition in CMP(MD) No.14292 of 2025 on condition that the petitioner shall deposit 50% of the award amount to the credit of MCOP No.3 of 2020 on the file of the Motor Accident Claims Tribunal/Chief Judicial Magistrate, Ramanathapuram within a period of four weeks from 16.10.2025, failing to deposit the said amount, the application shall stand automatically dismissed without further reference to this Court. Accordingly the petitioner also complied with the condition and filed memo before this Court on 11.11.2025. The appellant did not file two sets of copies, hence the Registry of this Court returned the same for want of filing of two sets of cost memo. In the meanwhile the time fixed 1/3

by this Court expired. Therefore the Registry of this Court informed the trial Court about the non compliance of the order passed by this Court, since this Court while allowing the condone delay petition imposed condition that if the petitioner has not complied with the condition the petition shall stand dismissed automatically without any further reference to this court

3. Considering the above facts and circumstances of the case, this Court concludes that the petitioner has complied with the condition imposed by this Court on 16.10.2025.

4. In view of the same, Registry is directed to number the appeal if it is otherwise in order and list it for admission in the usual course. Registry is also directed to print the name of the third respondent at the time of admission.
