PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari or any other writ or order or direction, to call for the records on the files of the third respondent pertaining to its order Na.Ka.11847/2015/A-9-2 dated 11.02.2015 and to quash the same and consequently direct the respondents to provide permanent shops with adequate space and amenities to all the existing vendors in the Gandi Markeet while shifting the market to the proposed Lorry Pettai. This writ petition has been filed by the Dindigul Annal Gandhi Market, Kaikani Commission Viyabarigal Nala Sangam as against the proceedings of the third respondent in Na.Ka. 11847/2015/A-9-2 dated 11.02.2015.
2.By the impugned proceedings, the Commissioner, Dindigul Municipal Corporation has decided to shift the Gandhi market from the existing place to Lorrypettai. 2/5
3.The third respondent has filed his counter affidavit with so many averments with regard to the prayer sought for by the petitioner, which runs to pages.
4.Today (15.02.2023), when this writ petition is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1,2 & 4 submits that they are not intending to shift the Gandhi market from the existing place. 5.Recording the submission made by the learned Additional Government Pleader that they are not intending to shift the Gandhi market from the existing place, this writ petition is closed as no further order is required.
