Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed vide his proceedings F.M.vz;. c.nr.Ngh/tp/C/Nfhgl;b/,epc/m.vz;086/2022 dated 15.10.2022 of the 1st respondent and quash the same as illegal and consequently, direct the 1st respondent to reinstate the petitioner into service based on his representation dated 17.10.2022.

ORDER

Heard the learned counsel on either side.

2. By the impugned order passed by the firs respondent, the petitioner has been suspended from service. The petitioner has some misgivings regarding the first respondent.

3. Considering the special facts and circumstances of this case, the petitioner is permitted to submit a petition for revocation of suspension before the second respondent who is a higher authority. The second respondent will consider the petitioner's plea for revocation of the suspension on merits and in 2/4

accordance with law. Such an order will be passed by the second respondent within a period of three weeks from the date of submission of the petitioner's representation.

4. The Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
