PRAYER: Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 to direct the third respondent police not to harass the petitioner under the guise of enquiry without due process of law. For petitioner : Mr. M.C. Maninder Nath.

ORDER

The petitioner sought a direction not to harass the petitioners under the guise of enquiry.

2. The learned Government Advocate (Crl.Side), on instructions, would submit that the defacto complainant had sought a direction from the learned Magistrate under Section 156 of Cr.P.C., on 13.08.2025 by directing the respondents to register an FIR against the petitioners and five others; and that they are not harassing the petitioners in any manner.

3. It is seen from the order of the learned Magistrate dated 13.08.2025 in Crl.O.P.No.525 of 2025, that there was a direction on the complaint given by one Lakshmi for registering the FIR. Therefore, this Court is of the view that the allegation of harassment is without any basis. 2/4

4. If the petitioners are aggrieved by the action taken by the respondents pursuant to the directions of the learned Magistrate, they are at liberty to seek appropriate remedy.
