ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 324 and 506(ii) IPC and Section 4 of TNPHW Act, 2002 in Crime No.152 of 2022, on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that on 24.10.2022, the petitioners and other accused were bursting crackers in front of the de-facto complainant's house and when the same was questioned by the https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.19205 of 2022 de-facto complainant, the accused persons abused the de-facto complainant and her husband in filthy language and attacked them with wooden stick and threatened them with dire consequences. Hence, the complaint.
3.The learned counsel for the petitioners would submit that the petitioners are innocents and they have been falsely implicated in this case. Hence, he prays for anticipatory bail. 4.The learned Government Advocate (Crl. side) as well as the learned counsel for the intervenor strongly opposed this petition stating that the injured is still in hospital and the investigation is still pending.
5.Considering the gravity and nature of the offence and also considering the facts that the injured is still in hospital and the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners.
