Learned counsel for the petitioner submits that he has been instructed to withdraw the writ petition by seeking leave to file a civil suit in respect of the grievance canvassed herein. He has made an endorsement for the said purpose.

2. By taking note of the same, W.P.(MD).No.4455 of 2016 is dismissed as withdrawn without any order as to costs. It is open to the writ petitioner to file a civil suit and claim the benefit of applicable provisions of the Limitation Act 1963. In such event, it will be for the receiving court to

decide whether the petitioner herein is entitled to the benefit of such provisions. Consequently connected W.M.P.(MD).No.4002 of 2016 is closed.
